1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you (“Client” or “User”) and Topan Adi Pamungkas (“Consultant”, “I”, “Me”) regarding access to and use of this website and my professional services.

2. Services Offered

I provide professional Performance Marketing services, including but not limited to:

  • Mobile User Acquisition (Google Ads, Meta Ads, TikTok Ads, etc.)
  • MMP (Mobile Measurement Partner) Setup & Audit.
  • Growth Strategy & Consultation.
  • Creative Performance Analysis.

3. Intellectual Property

  • Portfolio Content: All content on this website (case studies, text, graphics, logos) is my intellectual property or used with permission. You may not republish or redistribute this content without my express written consent.
  • Client Work: Intellectual property rights for work delivered to clients (e.g., specific ad strategies, custom reports) will be defined in a separate Service Agreement/Contract signed before the project begins.

4. No Guarantees (Performance Disclaimer)

Important: While I utilize industry best practices, historical data, and advanced strategies to drive growth:

  • I do not guarantee specific results (e.g., specific ROAS, CPI, or number of conversions) as digital marketing platforms (Google, Meta, Apple) are third-party environments subject to algorithm changes, market fluctuation, and competition.
  • Past performance strategies (as shown in my portfolio) are not indicative of future results for every business.

5. Limitation of Liability

In no event will I be liable for any indirect, consequential, or incidental damages arising out of the use of my services, including but not limited to loss of profit, loss of data, or ad spend wastage caused by third-party platform errors or suspensions.

6. Confidentiality

I respect the confidentiality of my clients. Any sensitive business data (metrics, budgets, P&L) shared during consultations or audits will be kept strictly confidential and will not be shared with third parties without your consent.

7. Governing Law

These Terms shall be governed by and defined following the laws of Indonesia. Any disputes related to these terms will be resolved within the jurisdiction of Indonesian courts.

8. Changes to Terms

I reserve the right to modify these terms at any time. Updated versions will be indicated by the “Last Updated” date.
